Agreement & Consent

By submitting content through the MomentWithUs intake form, email, or any other method, you confirm that you have read, understood, and agree to these Terms of Use and the accompanying Privacy Notice. You will be asked to acknowledge your agreement before any content is accepted. MomentWithUs will not begin building your celebration page until this consent is received and recorded.

These terms are written in plain language on purpose. No legal jargon, no tricks — just an honest explanation of how this works and what we're each responsible for.

What MomentWithUs Is

MomentWithUs.com is a personal project that creates celebration pages for life events like graduations, weddings, birthdays, and more. It is built and maintained by one person as a passion project and learning experience — it is not a registered business, corporation, or commercial enterprise. The service is offered on a free or low-cost basis at the sole discretion of the site operator.

No Guarantees of Availability

Because this is a personal project maintained by one person who also works full time, you should understand and agree to the following:

• There is no guaranteed uptime. The site may experience downtime for maintenance, technical issues, or hosting-related reasons. While every reasonable effort is made to keep celebration pages accessible, there is no service level agreement (SLA) and no guarantee of uninterrupted availability.
• Technical support response times may vary. Issues will be addressed as promptly as possible, but response times are not guaranteed. There may be delays of hours or days depending on the nature of the issue and the operator's availability.
• The service may change or end at any time. MomentWithUs reserves the right to modify, suspend, or discontinue the service — in whole or in part — at any time, with or without notice. If the service is discontinued, reasonable effort will be made to notify active users in advance so they can save their content.

Your Content

When you submit content for a celebration page (including but not limited to text, photos, names, and biographical information), you agree to the following:

• You have the right to share it. You confirm that you have permission to use and share any content you provide — including photos of other people. If your celebration page features another person (such as a graduate, birthday honoree, or wedding couple), you confirm that you have their knowledge and consent.
• You are responsible for what you submit. MomentWithUs does not review, verify, or endorse user-submitted content. You are solely responsible for ensuring your content is accurate, lawful, and does not infringe on anyone else's rights.
• Your content stays yours. You retain ownership of all content you provide. By submitting it, you grant MomentWithUs a limited, non-exclusive license to display that content on your celebration page for the duration that your page is active. This license ends when your page is removed.
• MomentWithUs may use your page as an example. With your explicit permission (which will be requested separately), your celebration page may be referenced or shown as an example of the service. You can decline this at any time, and your page will not be used as an example without your consent.

Content Guidelines

MomentWithUs is built for celebrations. Content that is hateful, threatening, harassing, sexually explicit, defamatory, or illegal is not permitted. MomentWithUs reserves the right to decline to build a page or to remove any page that violates these guidelines, at its sole discretion and without prior notice.

Internet Security & Privacy Risks

This is important, so please read it carefully:

• Nothing shared on the internet is ever fully secure. While reasonable precautions are taken to protect the site and its content, no website is immune to security vulnerabilities, data breaches, hacking attempts, or unauthorized access. By using MomentWithUs, you acknowledge and accept this inherent risk.
• Celebration pages are publicly accessible by default. Unless a privacy option (such as a passphrase or unlisted mode) is specifically configured, your celebration page can be viewed by anyone with the URL. Search engines may index publicly accessible pages.
• Think before you share. Do not include sensitive personal information on your celebration page that you would not want to be publicly visible — such as home addresses, phone numbers, financial account details, or government-issued identification numbers.
• External payment links are your responsibility. If your celebration page includes links to payment platforms (Venmo, CashApp, PayPal, Zelle, etc.), those transactions occur entirely on those third-party platforms. MomentWithUs has no involvement in, control over, or liability for any financial transactions conducted through those external services.

Limitation of Liability

MomentWithUs is provided "as is" and "as available," without warranties of any kind, either express or implied. To the fullest extent permitted by law:

• The site operator is not liable for any damages, losses, or costs arising from your use of the service, including but not limited to: loss of data, unauthorized access to your content, downtime or service interruptions, errors or inaccuracies on your celebration page, or any actions taken by visitors to your page.
• The site operator is not liable for any damages, losses, or costs arising from the use of third-party services linked from your celebration page, including payment platforms.
• The site operator's total liability to you for any claim arising from or related to this service shall not exceed the amount you paid for the service, if any.

Payment & Refunds

Where applicable, pricing for celebration pages is communicated before work begins. Payment terms are agreed upon between you and the site operator directly. Because each page involves custom work and time, refunds are handled on a case-by-case basis. If you are unsatisfied with your page, please reach out and we will work to make it right.

Page Duration, Removal & Data Retention

Hosting Duration

Celebration pages are hosted for the duration agreed upon at the time of creation. As your hosting period nears its end, reasonable effort will be made to contact you about renewal or removal options.

Grace Period

After your agreed hosting period ends, your page will be taken offline (no longer publicly accessible) but your content will be retained for 30 days. During this grace period, you may request reactivation of your page or request a copy of your page files for your own records. After the 30-day grace period, your celebration content will be permanently deleted as described below.

Requesting Early Removal

You may request removal of your page at any time by contacting the site operator. The same 30-day retention period applies unless you specifically request immediate deletion.

What Happens to Your Data After Removal

When your celebration page is permanently removed (after the grace period or upon your request for immediate deletion):

• Celebration content is deleted. Your photos, biographical text, page files, and all personal content will be permanently deleted from the hosting platform, code repository, and any local copies. Once deleted, this content cannot be recovered.
• Basic business records are retained. Your name, email address, event type, service dates, and payment history may be retained indefinitely for internal recordkeeping and service improvement purposes. These records are not shared with anyone.
• Code and design templates are retained. The underlying code structure, layout patterns, styling, and design techniques created during the building of your page are the work product of MomentWithUs and may be retained and reused. Any retained templates will be fully scrubbed of all personal content — names, photos, biographical text, and any identifying information will be removed. A retained template is a blank blueprint, not a copy of your page.

MomentWithUs-Initiated Removal

MomentWithUs also reserves the right to remove any page that violates these terms, that has remained inactive for an extended period after its agreed hosting duration, or if the service is discontinued. In the event of service discontinuation, reasonable effort will be made to provide advance notice and an opportunity to download your content.

Changes to These Terms

These terms may be updated from time to time. Changes will be reflected by the "Last updated" date at the top of this page. Continued use of the service after changes are posted constitutes acceptance of the updated terms. For active celebration page owners, reasonable effort will be made to notify you of significant changes.
